These Terms of Service ("Terms") govern your use of the Opensure platform and services provided ("Service").

By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you:

• Are at least 18 years of age
• Have the authority to enter into these Terms
• Agree to comply with all applicable laws and regulations

2. Description of Service

Opensure provides insurance operations software, including:

• Web-based dashboard for managing insurance workflows
• Browser extensions for prospecting and carrier matching
• API integrations for insurance data processing
• Analytics and reporting tools

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer or decompile the software
• Share your account credentials with others
• Use automated tools to scrape or extract data without permission
• Violate any applicable insurance regulations

5. Subscription and Payment

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We may change pricing with 30 days notice

Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your billing period
• No refunds for partial billing periods

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data and grant us a license to process it to provide the Service.

7. Intellectual Property

• The Service and its content are owned by InsureCert Systems Inc.
• You retain ownership of data you submit to the Service
• You may not copy, modify, or distribute our software without permission

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSURECERT SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless InsureCert Systems Inc. from any claims arising from your use of the Service or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

12. Termination

We may terminate your access to the Service if you violate these Terms. Upon termination, you may request export of your data within 30 days.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
